Introduction

Despite the state’s strong recognition of the right to information, as evidenced by its constitutionalisation, Mozambique’s legal framework rated poorly by the methodology due to several key flaws and legislative gaps. The efficacy of the law is restricted by its rather narrow scope, which only applies to executive administration. This restrictive issue is further complicated by a rather non-compliant exceptions regime that includes several broad exemptions that, for the most part, are not harm-tested or subject to a proper public interest override. The most influential flaw, however, is the complete lack of an administrative oversight body for external reconsideration of refused requests.
